1. Acceptance of Terms

By accessing this website and using our services, you agree to be bound by these Terms of Service. “We”, “our”, and “us” refer to Penthouse Punta Cana, the operator of the vacation rental penthouse located in Coral Village II, Bavaro, Punta Cana, Dominican Republic. “You” and “Guest” refer to the person making a booking or visiting our website.

2. Services

We offer short-term and long-term rental of an exclusive two-level penthouse with private rooftop, jacuzzi, and BBQ. Bookings may be made:

• Via Airbnb — subject to Airbnb’s Terms of Service and cancellation policy
• Directly — by contacting us at [email protected] for special offers or long-term stays (6–12 months)

3. Booking and Payment

• Airbnb bookings: Payment, cancellation, and refunds are governed by Airbnb’s policies.
• Direct bookings: Terms, payment schedule, and security deposit are agreed in writing. A refundable security deposit may be required.
• Long-term rentals (6–12 months): Conditions, pricing, and deposit (typically two months’ rent) are set out in the rental agreement.

4. Guest Obligations

Guests agree to:

• Provide accurate information and comply with check-in/check-out instructions
• Use the property for lawful residential purposes only; no parties or events without prior approval
• Respect the property, neighbors, and house rules
• Report any damage or malfunction promptly
• Comply with local laws and regulations in the Dominican Republic

5. Cancellation

For Airbnb bookings, cancellation policies are set by Airbnb and shown at the time of booking. For direct and long-term bookings, cancellation terms are specified in the rental agreement or confirmation email.

6. Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, including loss of enjoyment, delays, or issues arising from third-party services (e.g., Airbnb, transfers). Our liability is limited to the amount paid for the accommodation. Guests are responsible for their personal belongings and travel insurance.

7. Website Use

You may use this website for lawful purposes only. We reserve the right to modify or discontinue the site or services at any time without liability. Content (text, images, descriptions) is for informational purposes; we strive for accuracy but do not guarantee that all information is complete or up to date.

8. Governing Law

These Terms are governed by the laws of the Dominican Republic. Any disputes shall be resolved in the courts of the Dominican Republic.

9. Changes

We may update these Terms at any time. The “Last updated” date indicates the latest revision. Continued use of our services after changes constitutes acceptance of the revised Terms.
